Guest registration for holiday rentals in Spain: who is responsible?

Spain’s accommodation rules require guest data to be communicated through the official system, with different record-keeping duties for professional and non-professional operators.

Asking guests for identification is rarely anyone’s favourite part of check-in. Still, accommodation providers have registration duties. Here is how to make the process organised, clear and careful with personal data.

Guest registration is an operational obligation, not just an administrative formality at reception. Royal Decree 933/2021 covers people and businesses carrying out accommodation activities in Spain, including private operators. The Ministry of the Interior uses the SES.HOSPEDAJES platform for the required communications.

Professional and non-professional operators

The Ministry states that both professional and non-professional accommodation activity can fall within the decree. Professional operators have registration, communication and data-retention duties. Non-professional accommodation providers are exempt from the decree’s computerised register and retention duties but remain subject to the communication obligations. This distinction should be checked against the owner’s actual business status.

Data handling needs a process

The required information includes guest and transaction data listed in the annexes to the decree. Professional operators must retain the electronic register for three years after the contracted service ends. Because this is personal information, owners and managers also need a sensible privacy and access process: collect what is required, transfer it securely and avoid casually storing copies in personal messaging apps or unprotected spreadsheets.

  • Collect the prescribed guest data accurately.

Outsourcing does not mean ignoring it

A property manager can handle registration tasks operationally, but the parties should clearly agree who does what and ensure the legal obligation is actually fulfilled.

Does the rule also affect private owners?

Yes. The Ministry’s FAQ states that private individuals can be subject to the communication obligations.

Is SES.HOSPEDAJES the booking platform?

No. It is the Ministry of the Interior’s official system for the relevant accommodation-registration and information obligations.

Can I keep guest passport photos forever just in case?

Do not collect or retain more personal data than the applicable legal basis requires. The registration obligation and privacy obligations should be handled together.
